  • Client/You/Your: The person or legal entity purchasing or using the Services.

  • Account: Your client portal/profile with Awesomehost.

  • Order: Any purchase, subscription, renewal, or service request submitted to Awesomehost.

  • Third-Party Services: Services provided by entities other than Awesomehost (e.g., registries/registrars, payment gateways, software vendors).


3) Eligibility & Account Responsibilities

3.1 You must provide accurate, current information when creating an Account or ordering Services.
3.2 You are responsible for:

  • safeguarding your Account credentials,

  • all activity under your Account, and

  • ensuring your Content and use comply with these Terms and applicable laws.

3.3 Notify us immediately if you suspect unauthorised access or a security incident involving your Account.


4) Our Services

We provide (as applicable):

  • Web hosting / WordPress hosting / reseller hosting

  • Email hosting

  • Domain registration, transfers, renewals, and DNS management (where purchased)

  • Website design and development

  • Online store (eCommerce) development

  • Technical support and maintenance (based on your plan)

We may modify, upgrade, or update Services to improve security, performance, or compliance, provided such changes do not materially reduce the paid Service without reasonable cause.


5) Orders, Pricing & Payment

5.1 Pricing: Prices are displayed on our website, quotations, or invoices and may change from time to time. Renewals may be billed at the then-current renewal rates unless otherwise agreed in writing.

5.2 Payment methods: We accept payments via bank transfer/EFT and third-party payment gateways (where available). Payment gateway usage is subject to the gateway provider’s terms and policies.

5.3 Payment confirmation:

  • Gateway payments are typically confirmed automatically.

  • EFT payments may require verification and correct reference matching.
    You are responsible for using the correct payment reference and providing proof of payment when requested.

5.4 Taxes and charges: Prices may exclude applicable taxes/levies unless expressly stated otherwise.


6) Billing Cycles, Renewals & Late Payment

6.1 Services are billed monthly, annually, or as specified in your Order/Invoice.

6.2 Renewals: You are responsible for ensuring renewals are paid on time. Some services may renew automatically where configured.

6.3 Late payment: If payment is not received by the due date, we may:

  • apply late-payment administration charges where applicable, and/or

  • suspend Services until payment is received and verified.

6.4 Reminders: Payment reminders may be sent as a courtesy; however, you remain responsible for timely payment even if reminders are not received.


7) Suspension, Restriction & Termination

7.1 We may suspend or restrict Services (temporarily) if:

  • payment is overdue,

  • there is suspected fraud, abuse, or security risk,

  • you breach the Acceptable Use Policy (Section 9),

  • your use threatens the stability of our systems or other clients, or

  • we are required to do so by law or a competent authority.

7.2 During suspension, services (including websites and email) may be inaccessible.

7.3 We may terminate Services if:

  • you materially breach these Terms and fail to remedy the breach after notice where reasonably possible,

  • you repeatedly fail to pay on time, or

  • the Service becomes illegal or impossible to provide.

7.4 Upon termination, you remain liable for all outstanding amounts up to the termination date.


8) Domain Registration, Transfers & DNS

8.1 Domain services are subject to the rules and requirements of the relevant domain registry/registrar.

8.2 Ownership: If you purchase a domain through us, you remain the registrant/owner (subject to registry rules) provided your account remains in good standing and renewal fees are paid.

8.3 Expiry & redemption: If a domain expires, it may enter suspension, redemption, or restoration phases governed by the registry/registrar and may incur additional fees. Domain recovery timelines and costs may be outside our control.

8.4 DNS changes: DNS updates can take time to propagate globally. You are responsible for the accuracy of DNS instructions you provide.

8.5 Transfers: Transfers may require an authorisation code, unlocking, and administrative email approval. Transfer timing is controlled by registry/registrar processes.


9) Acceptable Use Policy (AUP)

You may not use the Services for unlawful, harmful, or abusive activities, including but not limited to:

  • phishing, fraud, impersonation, or scams

  • malware distribution, hacking, or unauthorised access

  • sending spam or unsolicited bulk messages

  • hosting or distributing copyrighted content without permission

  • unlawful, abusive, hateful, or harmful content

  • excessive resource usage that disrupts systems or other clients

  • activities that violate third-party terms (including payment gateways and registries)

We may remove or restrict access to Content or Services that violate this AUP.


10) Email Hosting Rules

10.1 You must not use email services for spam, phishing, bulk unsolicited mailing, or any activity that harms email reputation.

10.2 We may apply security controls, filtering, rate limits, or blocks to protect systems and maintain service integrity.

10.3 Deliverability: We do not guarantee inbox placement. Delivery outcomes depend on factors including recipient mail systems and sender reputation.


11) Backups & Client Data Responsibility

11.1 Backup availability, frequency, and retention depend on your plan and/or service description.

11.2 You are encouraged to maintain your own independent backups of your website, databases, and email.

11.3 While we take reasonable measures to protect systems and maintain service reliability, you acknowledge that data loss can occur due to factors such as software failures, third-party issues, malware, or human error.


12) Uptime, Maintenance & Support

12.1 We aim to provide stable uptime; however, 100% uptime is not guaranteed.

12.2 Planned maintenance may be required for security and performance. Where reasonably practical, we will provide notice.

12.3 Support availability and response times depend on your plan and the nature of the request. Some issues may require coordination with third parties (registries, payment gateways, upstream providers).


13) Website Design & Development Terms

13.1 Scope: Website design/development is delivered according to the agreed quotation/proposal (pages, features, integrations, timelines, and responsibilities).

13.2 Client responsibilities: You must provide timely content, approvals, and access details. Delays from the client side may affect project timelines.

13.3 Revisions & change requests: Revisions are provided as agreed in your package/quote. Additional revisions or scope changes may be quoted separately.

13.4 Third-party assets: You are responsible for licensing third-party materials (images, fonts, plugins, themes) unless we explicitly supply them.

13.5 Launch approval: Once you approve and the website is launched, further changes may be treated as new work.


14) Online Stores (eCommerce)

14.1 eCommerce functionality may rely on third-party providers (payment gateways, shipping tools, tax tools). Availability and performance may depend on those providers.

14.2 You are responsible for:

  • product and pricing accuracy,

  • legal compliance (including consumer protection rules and required disclosures),

  • refunds/returns policies (published on your store), and

  • lawful sale of products/services.


15) Third-Party Services

15.1 Certain Services depend on Third-Party Services. We are not responsible for outages, changes, or decisions by third parties outside our control.

15.2 You may be required to accept third-party terms and/or pay third-party fees (e.g., registry fees, redemption fees, chargeback fees).


16) Refunds, Cancellations & Credits

All refunds, cancellations, and credits are governed by our Refund Policy, available on a separate page on our website (“Refund Policy”). The Refund Policy forms part of these Terms by reference.

Where the Refund Policy conflicts with these Terms on matters of refunds/cancellations/credits, the Refund Policy will apply.


17) Intellectual Property

17.1 We retain ownership of our platforms, systems, processes, templates, and documentation.

17.2 You retain ownership of your Content.

17.3 For website design work, ownership/licensing of delivered work will follow the agreement/quotation and is typically granted upon full payment, subject to any third-party licensing limitations.


18) Confidentiality

Each party agrees to keep confidential information private, except where disclosure is required by law or necessary to deliver the Services.


19) Privacy & Data Protection

We process personal information according to our Privacy Policy. By using the Services, you consent to such processing as described in the Privacy Policy.


20) Limitation of Liability

20.1 To the maximum extent permitted by law, Awesomehost will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.

20.2 Our total liability for any claim relating to the Services will not exceed the amount paid by you to us for the affected Service during the three (3) months immediately preceding the event giving rise to the claim, except where the law requires otherwise.

20.3 Nothing in these Terms limits liability that cannot legally be excluded or limited.


21) Indemnity

You agree to indemnify and hold Awesomehost harmless from any claims, damages, liabilities, costs, and expenses arising from:

  • your Content,

  • your misuse of Services,

  • your breach of these Terms, or

  • your violation of law or third-party rights.


22) Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, war, strikes, government actions, power or internet outages, or upstream provider failures.


23) Dispute Resolution

23.1 Please contact support@awesomehost.net first to attempt informal resolution.

23.2 If unresolved, the parties will attempt to resolve the dispute in good faith, including mediation where practical, before court proceedings.


24) Governing Law & Jurisdiction

These Terms are governed by the laws of Kenya. The courts of Kenya shall have jurisdiction, unless mandatory consumer protection laws require otherwise.


25) Changes to These Terms

We may update these Terms from time to time. The latest version will be posted on www.awesomehost.net with an updated “Last updated” date. Continued use of the Services after updates means you accept the revised Terms.
